All services or products provided by Flagon Digital may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any EU law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The members and sellers agree to indemnify and hold harmless Flagon Digital from any claims resulting from the use of service which damages the subscriber or any other party.
Prohibited is content that promotes any illegal activity or present content that may be damaging to Flagon Digital' servers or any other server on the Internet. Links to such materials are also prohibited. Examples of unacceptable content or links:
- pirated software
- hacker programs or archives
- Mining software
- any physical items or products (only digital products accepted)
- tobacco products, prescription drugs, dietary supplements and alternative health products, live streaming; the sale or supply of alcoholic beverages, drugs and drug paraphernalia, weapons (including without limitation, knives, guns, firearms or ammunition), satellite and cable TV descramblers, material which incites violence, hatred, racism or which is considered obscene, government IDs and licences including replicas and novelty items and any counterfeit products, unlicensed or illegal lotteries or unlicensed or illegal gambling services (including without limitation the use of or participation in illegal gambling houses), unregistered charity services, items which encourage or facilitate illegal activities, products or services which includes multi-level marketing, pyramid selling or ponzi schemes, matrix programmes or other “get rich quick” schemes or high yield investment programmes, goods or services that infringe the intellectual property rights of a third party, un-coded/miscoded gaming, timeshares or property reservation payments (On and Off Plan)
NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3, IMAGE FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE, AND A $50.00 CANCELLATION FEE WILL APPLY. ADDITIONALLY, Flagon Digital WILL NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS.
Payout
Seller' vendor account will receive its payout only when reaching the threshold of $100USD. The payouts are made at the beginning of each month, between the 6th and the 12th only via PayPal. If the seller (vendor) has not reached its target, the commission will be kept in the seller account until the threshold is reached or exceeded.
Refunds
If you purchase a completely malfunctioned code or product, and you notify the vendor (seller) in writing message via your Client Area within the first 8 days of your purchase that you wish to cancel, you will be given a refund of the contract amount, excluding fees and overages. In case code or theme has some minor issue please resolve them with the product's seller directly. The product can not be refunded in case of some features, services, or tools are not covered in the digital product description.
Graphic, audio, video-related products & services are not refundable - this including, but not limited to mp3, .psd, .jpg, .ai, .mov, .mp4 etc. Also, Software licenses are not refundable. SEO and Design services will not be refunded if you have been notified that the service is being implemented. If you paid the invoice using any payment method that has a gateway fee, you can ask a refund only for the service/product listed in your invoice. The gateway fee value is not refundable.
If your account was involved in illegal activities like spam/phishing/copyright infringement/adult material and not limited to you won't be able to receive a refund
If you fail to provide client verification documents you won't receive a refund.
Refusal of Service
We reserve the right to refuse, cancel or suspend an account, at our sole discretion.
Limitation of Liability
Flagon Digital shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Flagon Digital' products or services. Furthermore, Flagon Digital shall not be responsible for any claimed damages, including incidental or consequential damages. All damages shall be limited to the immediate termination of service.
Disclaimer
Flagon Digital cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a customer would have gained if their site was functioning. Certain services or products provided by Flagon Digital are resold. Thus, certain equipment, routing, software and programming used by Flagon Digital are not directly owned or written by Flagon Digital. Moreover, Flagon Digital holds no responsibility for the use of our customer' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Flagon Digital sees fit.
We comply with all applicable sanctions’ regimes (including OFAC sanctions) and in particular that you do not operate in or have any exposure to the following countries, whether in terms of your supply chain, operations, or sales to customers in these countries or regions:
a) Crimea b) Cuba c) Donetsk d) Iran e) Luhansk f) North Korea g) Syria
Account Activation
By activating your account with Flagon Digital, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer.
NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail prior to taking any action to provide you with an opportunity to correct the problem.
